Maui Travel – Terms and Conditions
At Maui Travel, we care deeply about your experience, safety, and satisfaction. These Termsand Conditions are here to make sure everything runs smoothly and that we’re all on the samepage before your ocean adventure begins. While we’ve kept the legal stuff clear andprofessional, our goal is always to approach every situation with fairness and care. If anythingfeels unclear or if you have questions, don’t hesitate to reach out — we’re here to help.
1. DEFINITIONS
1.1 "Maui Travel" refers to the company responsible for organizing the contracted Trip,including any third-party providers engaged to support the delivery of the Trip.
1.2 "Participant" refers to the individual who has booked and will participate in the Trip.Participation may be subject to certain restrictions (e.g., age, health, or physical condition).Please contact us if you are unsure of your eligibility.
1.3 "Trip" refers to the oceanic travel experience provided by Maui Travel as described in the Trip Program.
1.4 "Trip Cost" refers to the total price of the Trip as outlined in the Trip Program.
2. BOOKING AND PAYMENT
2.1 To confirm a booking, a 30% deposit of the Trip Cost is required once availability isconfirmed by Maui Travel.
2.2 The remaining balance is due 60 days prior to the scheduled start date of the Trip.
2.3 The Trip Cost may include components that are subject to market fluctuation (e.g., fuelsurcharges). Maui Travel reserves the right to adjust the Trip Cost if such fluctuations exceed±10%.2.4 By submitting payment, the Participant confirms that they have read, understood, andagreed to these Terms and Conditions.
3. CANCELLATIONS AND REFUNDS
3.1 All cancellations must be submitted in writing via email or WhatsApp.
3.2 Deposits are non-refundable. However, under certain circumstances and at Maui Travel’sdiscretion, a voucher equivalent to the deposit amount may be issued for future use.
3.3 Participants are strongly advised to purchase travel insurance that includes trip cancellation coverage at the time of booking.
4. SERVICES AND ITINERARY
4.1 Maui Travel commits to delivering the Trip with professional care and in accordance withindustry standards.
4.2 Maui Travel may engage third-party service providers. While we take reasonable care inselecting these providers, we cannot be held responsible for their actions or omissions.
4.3 Participation in the Trip entails inherent risks associated with oceanic travel and outdooractivities.
4.4 Specific wildlife sightings or experiences are not guaranteed, as they are subject toenvironmental and natural conditions beyond Maui Travel’s control.
4.5 Maui Travel reserves the right to adjust the itinerary due to factors such as weather, safetyconcerns, or operational requirements. In the event of significant changes, reasonablealternatives will be offered where possible.
5. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY
5.1 By booking, the Participant acknowledges that participation is voluntary and undertaken attheir own risk. Ocean-based activities carry potential risks, including but not limited tounpredictable sea conditions, encounters with wildlife, and physical exertion.
5.2 Maui Travel shall not be liable for indirect or consequential losses, loss of profit, or personalinjury arising from the Trip, whether caused by Maui Travel or third parties.
5.3 Maui Travel accepts no liability for cancellations, delays, or other disruptions caused byfactors beyond its reasonable control.
5.4 Maui Travel’s total liability shall not exceed the total Trip Cost paid by the Participant.
5.5 The Participant agrees to release, indemnify, and hold harmless Maui Travel, itsemployees, agents, and affiliates from any claims or liabilities arising from their participation,including but not limited to injury, loss, damage, or delay.
6. INSURANCE
6.1 The Participant is required to obtain comprehensive travel insurance at their own expense,covering medical emergencies, evacuation, cancellations, and all activities included in the Trip.
6.2 For specialized activities such as scuba diving, additional or specific insurance is theresponsibility of the Participant.
6.3 Participants must submit proof of insurance prior to the start of the Trip.
6.4 It is solely the Participant's responsibility to ensure their insurance policy adequately coverstheir needs.
7. HEALTH AND FITNESS
7.1 Trips offered by Maui Travel may involve physical activity. Participants must ensure they arein an adequate physical condition to safely engage in the Trip.
7.2 A health declaration may be required before participation.
7.3 Maui Travel reserves the right to deny participation to individuals whose health conditionsmay pose a safety risk to themselves or others.
8. CONDUCT AND COMPLIANCE
8.1 All Participants must follow the instructions of the guide(s) and respect all safety protocols,environmental regulations, and local customs.
8.2 Maui Travel maintains a zero-tolerance policy regarding inappropriate behavior, includingbut not limited to harassment, aggression, or misconduct. Any Participant engaging in suchbehavior may be removed from the Trip at their own expense.
8.3 Non-compliance with instructions or regulations may also result in removal from the Tripwithout refund.
9. DAMAGES
9.1 The Participant shall be responsible for any damage caused to property or equipment duringthe Trip.
9.2 Maui Travel is not liable for damage caused by other Participants.
10. MEDIA AND PRIVACY
10.1 Maui Travel may document the Trip through photography and videography for promotionaluse.
10.2 By joining the Trip, the Participant consents to the use of their image unless they notifyMaui Travel in writing prior to the Trip.
10.3 We are committed to protecting your personal data. Any information provided byParticipants will be processed and stored securely in accordance with applicable UAE data protection laws. Please refer to our separate Privacy Policy for detailed information on datacollection, usage, and protection.
11. FORCE MAJEURE
Maui Travel shall not be held liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control,including, but not limited to, natural disasters, acts of terrorism, war, civil unrest, governmental restrictions, pandemics, or any other event that constitutes a force majeure. In the event of a force majeure, Maui Travel reserves the right, at its sole discretion, to postpone, modify, or cancel the Trip. While we will make every effort to minimise any inconvenience, please understand that refunds or compensation for costs incurred may not be available under theseCircumstances.
12. MAUI TRAVEL-INITIATED CANCELLATIONS AND ITINERARY CHANGES
If Maui Travel cancels or significantly alters the Trip for reasons within our control, we will make every effort to notify Participants promptly. In such cases, you will be offered a full refund, the option to reschedule for a comparable Trip, or a voucher for future travel with Maui Travel. MauiTravel also reserves the right to make changes to the itinerary of the Trip if this becomes necessary for any reason.
13. COMPLAINTS AND DISPUTE RESOLUTION
In the event of any complaint or dispute, we encourage you to contact us directly so that we canattempt an amicable resolution. If a resolution cannot be reached through informal discussions,the dispute will be subject to the dispute resolution process as provided in Section 16 below.
14. AMENDMENTS TO TERMS
Maui Travel reserves the right to modify or amend these Terms and Conditions at any time.Participants will be notified of any material changes through the contact information provided atbooking. Continued participation in a Trip after such modifications constitutes acceptance of therevised Terms.
15. EMERGENCY CONTACTS AND MEDICAL INFORMATION
For your safety, all Participants must provide current emergency contact information and anypertinent medical details prior to the Trip. This information will be used solely in case of anemergency and will be kept confidential in accordance with applicable privacy laws.
16. GENERAL TERMS
These Terms and Conditions, together with any applicable waiver or signed disclaimer, form thecomplete agreement between the parties. If any provision is deemed unenforceable, theremainder of the agreement shall remain valid. These Terms are governed by the laws of theUnited Arab Emirates, and any disputes shall be resolved under the jurisdiction of UAE courts.
