These Terms & Conditions govern all bookings, participation, and services provided under the Maui brand ("Maui", "we", "us", "our"). By submitting an application, paying a deposit, or participating in a Maui expedition, you agree to be bound by these Terms.

Maui is operated by Majortale Global FZ-LLC, registered in Ras Al Khaimah Economic Zone, United Arab Emirates.

1. Application & Booking Process

All prospective guests must complete a Maui application form. Submission does not guarantee acceptance. Maui reserves the right to accept or decline any application at its sole discretion to ensure group compatibility and expedition safety. Your booking becomes confirmed only upon acceptance of your application by Maui, receipt of your deposit payment, and written confirmation from Maui. Bookings are non-transferable to other individuals without prior written approval from Maui. Transfer requests must be submitted at least 60 days before departure and may incur administrative fees.

2. Payment Terms

A non-refundable deposit (typically 40% of the total trip price, unless stated otherwise) is required within 7 days of booking confirmation to secure your place on an expedition. The remaining balance must be paid in full by the deadline communicated during booking (typically 10–30 days prior to departure, depending on the expedition). Failure to meet this deadline may result in automatic cancellation without refund.

All prices are quoted in USD unless otherwise stated. Payment can be made via credit card, bank transfer, or other methods as communicated during booking. Currency conversion fees and international transaction charges are the responsibility of the guest. Maui reserves the right to adjust trip prices in response to changes in operational costs, fuel prices, taxes, exchange rates, or other unforeseen circumstances. Price changes will not affect bookings where deposits have already been paid.

3. Cancellations & Refunds

All deposits are non-refundable under any circumstances. For cancellations more than 30 days before departure, if Maui successfully fills your spot, a partial refund (minus deposit and administrative costs) may be offered at Maui's sole discretion. Cancellations within 30 days of departure will not receive any refunds regardless of circumstances. Maui expeditions require a minimum number of confirmed guests to operate. If minimum numbers are not reached, Maui reserves the right to cancel the expedition with at least 30 days' notice. In this case only, all payments will be fully refunded, but no additional compensation will be provided.

If Maui cancels an expedition for operational reasons (excluding force majeure), guests will receive a full refund or the option to transfer to an alternative expedition of equal or greater value. We strongly recommend comprehensive travel insurance covering trip cancellation, delays, medical emergencies, evacuation, lost baggage, and adventure activities. Refunds will not be issued for personal circumstances that would typically be covered by travel insurance, including illness, family emergencies, or travel disruptions.

4. Nature of the Experience & Risk Acknowledgment

Maui expeditions involve ocean activities, wildlife encounters, boating, swimming, snorkeling, freediving, and travel in remote locations with limited medical facilities. These activities carry inherent risks, including but not limited to changing sea conditions and weather, physical exertion and potential injury, unpredictable wildlife behavior, remote locations with limited emergency services, and sun exposure and marine hazards.

By joining a Maui expedition, you acknowledge that participation is entirely voluntary, you understand and accept these risks, you participate at your own risk, and you have adequate insurance coverage. To the fullest extent permitted by law, Maui, Majortale Global FZ-LLC, its directors, employees, contractors, partners, and affiliates shall not be held liable for any injury, illness, death, loss, damage, or expense incurred during or in connection with an expedition. This includes, but is not limited to, losses arising from accidents, wildlife encounters, weather conditions, equipment failure, or actions of third parties.

5. Wildlife & Natural Environment

All wildlife encounters take place in natural, uncontrolled environments. While Maui carefully selects locations and timing based on known wildlife patterns, specific animal sightings are never guaranteed. The ocean is unpredictable, and marine life movements are beyond our control. Ocean conditions, visibility, and weather directly impact activity schedules. Maui guides will make all activity decisions based on safety and optimal conditions.

No refunds or compensation will be provided for missed or limited wildlife encounters, altered itineraries, or weather-related changes. Guests must follow all wildlife interaction guidelines, local regulations, and Maui's environmental protocols. Failure to comply may result in removal from the expedition without refund.

6. Health, Fitness & Medical Requirements

Guests must possess basic swimming ability and comfort in open water, physical fitness suitable for ocean activities, ability to board and exit boats and navigate uneven surfaces, and the capacity to participate in activities for several hours daily. You must disclose any relevant medical conditions, medications, allergies, or physical limitations during the application process and prior to departure. This includes but is not limited to heart conditions or respiratory issues, pregnancy, recent surgeries or injuries, chronic conditions affecting physical ability, and severe allergies or dietary restrictions. Maui will make reasonable efforts to accommodate dietary restrictions when disclosed in advance. However, in remote locations, options may be limited.

Guests with severe allergies or specific medical dietary needs must communicate these clearly and accept responsibility for their own safety. Maui reserves the right to request medical clearance from a physician, deny participation if a condition poses safety risks, or remove a guest from an expedition if their health deteriorates. Maui is not responsible for medical treatment costs, evacuation expenses, hospital fees, or any related expenses incurred during or after the expedition. Emergency medical evacuation from remote locations can cost tens of thousands of dollars. Travel insurance with comprehensive medical and evacuation coverage is essential.

7. Travel Documents & Requirements

You are solely responsible for holding a valid passport with minimum 6 months validity beyond your return date, obtaining all necessary visas and entry permits, securing COVID-19 or other health documentation as required by destination countries, and understanding and complying with local laws and customs. Maui is not responsible for any costs, losses, or missed expedition days resulting from inadequate documentation, visa denial, or entry refusal. No refunds will be provided.

8. Guides, Partners & Subcontractors

Maui collaborates with carefully selected local guides, boat operators, accommodation providers, dive centers, and marine professionals. These parties operate as independent contractors and are not employees or agents of Maui. They maintain their own insurance and operational standards. Accommodation standards vary by location and may range from boutique hotels to liveaboard vessels or eco-lodges. While Maui selects high-quality providers, specific room assignments, vessel layouts, and service standards are not guaranteed and may differ from descriptions or expectations.

Maui is not liable for acts, omissions, negligence, or failures of third-party service providers. This includes but is not limited to boat operators, accommodation providers, transportation services, and activity operators. Participation in a Maui expedition constitutes acceptance of these arrangements.

9. Guest Conduct & Community Standards

Maui expeditions are built on mutual respect and shared experiences. Guests are expected to treat staff, guides, local communities, and fellow guests with respect, follow all safety instructions and guidelines, respect wildlife and marine ecosystems, contribute positively to group dynamics, and comply with local laws and customs. The following behaviors are strictly prohibited: harassment, bullying, or discrimination of any kind, sexual misconduct or unwanted advances, aggressive or threatening behavior, illegal drug use or excessive alcohol consumption, intentional disturbance of wildlife, damage to marine environments, and refusal to follow safety instructions.

Maui maintains a zero-tolerance policy for conduct violations. Any guest engaging in prohibited behavior may be immediately removed from the expedition without refund. All costs associated with early departure, alternative accommodation, and transportation will be the sole responsibility of the guest. No partial refunds will be provided.

10. Itinerary Changes & Force Majeure

Published itineraries are indicative only. Weather conditions, sea states, safety concerns, wildlife patterns, logistical factors, or government restrictions may require changes to daily schedules and activities, dive or snorkel sites, accommodation or vessel arrangements, and transportation methods. Such changes are made in the best interest of guest safety and experience quality. They do not entitle guests to refunds or compensation.

Maui shall not be liable for delays, changes, or cancellations caused by events beyond reasonable control, including but not limited to natural disasters, extreme weather, or tsunamis, pandemics, epidemics, or public health emergencies, government actions, travel restrictions, or border closures, political unrest, terrorism, or civil disturbances, transportation strikes or mechanical failures, and supplier bankruptcies or operational failures. In force majeure situations, Maui will make reasonable efforts to provide alternatives but cannot guarantee refunds or compensation.

11. Equipment & Personal Property

Maui or its partners typically provide basic snorkeling equipment. Guests are responsible for bringing personal items and medications, reef-safe sunscreen, appropriate clothing and swimwear, cameras and electronics, and any specialized equipment such as freediving fins or wetsuits. Maui is not responsible for loss, theft, or damage to personal belongings, malfunction of personal equipment, or damage to rental equipment caused by guest negligence. Guests are fully liable for any damage caused to accommodation, vessels, equipment, or property. Repair or replacement costs will be charged immediately and must be paid before departure.

12. Photography, Media & Intellectual Property

Maui may capture photographs, videos, and other content during expeditions for marketing, social media, website use, and promotional purposes. By participating in a Maui expedition, you grant Maui perpetual, royalty-free permission to use your likeness, voice, and image in any media format worldwide unless you notify us in writing prior to the expedition start date. To opt out of media use, email info@mauitravel.io before your expedition begins.

Opting out does not affect group photos where you may appear in the background. Guests retain ownership of their personal photos and videos but grant Maui permission to share tagged content from social media for promotional use. If you prefer your content not be shared, communicate this to your expedition leader.

13. Privacy & Data Protection

Maui collects personal information including contact details, medical information, passport data, and payment information necessary to operate expeditions safely and effectively. Your information is used solely for expedition management and communication, safety and emergency purposes, payment processing, improving our services, and marketing communications with your consent. We do not sell personal information.

We may share necessary data with local partners and service providers, emergency services if required, and legal authorities when mandated by law. By booking, you consent to receive expedition updates and marketing communications. You may unsubscribe at any time via email links or by contacting us directly.

14. Complaints & Dispute Resolution

If issues arise during an expedition, please notify your expedition leader or Maui representative immediately so we can address them in real-time. Post-expedition complaints must be submitted in writing to info@mauitravel.io within 14 days of expedition completion. Include your booking reference, detailed description of the issue, supporting evidence such as photos or witness accounts, and your desired resolution. Maui will investigate all complaints and respond within 30 days. Our decision on any complaint shall be final.

15. Liability Waiver & Indemnification

By participating in a Maui expedition, you agree to release Maui and Majortale Global FZ-LLC from any and all claims, indemnify Maui against claims made by third parties arising from your participation, hold harmless Maui from any liability related to injury, illness, death, or property loss, and accept that this release applies to claims arising from Maui's negligence to the fullest extent permitted by law. This waiver extends to all directors, employees, contractors, partners, and affiliated entities.

16. Legal Framework

These Terms & Conditions are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Maui reserves the right to amend these Terms at any time.

Material changes will be communicated to guests with confirmed bookings. Continued participation constitutes acceptance of updated Terms. These Terms constitute the entire agreement between you and Maui. Any verbal representations or informal communications do not supersede these written Terms.

17. Age Requirements

Guests must be at least 18 years of age to book and participate independently. Minors under 18 may participate only when accompanied by a parent or legal guardian throughout the expedition, with written parental consent provided in advance, and subject to Maui's approval based on expedition suitability.

19. Acceptance of Terms

By submitting an application, paying a deposit, or participating in a Maui expedition, you confirm that you have read these Terms & Conditions in full, understood all provisions and risks, agreed to be legally bound by these Terms, and acknowledged that these Terms may affect your legal rights.
